General Terms and Conditions of Sale and Use

1. The service

Fidelbee allows business owners (hereinafter “the Client”) to create a digital loyalty card, to offer it to their own customers via a QR code (in Apple Wallet, Google Wallet or on a web page) and to manage stamps, rewards and notifications from an online dashboard. The service is reserved for professionals.

One subscription covers a single location, whose address is registered in the Client's dashboard. The QR code and the stamps only work at that address. Using the same account in several locations is prohibited: each additional location requires its own subscription. Fidelbee may suspend any account that does not comply with this rule.

2. Plans and prices

Prices may change; any change is announced at least 30 days in advance, and the Client may cancel before it takes effect.

3. Free trial

Each business is entitled to a free trial of 14 days, once only. If no payment method has been registered by the end of the trial, the subscription stops automatically, at no cost.

4. Payment and term

The subscription is payable monthly in advance, by bank card via Stripe. It has no minimum term and renews every month. If a payment fails, access to the stamping features may be suspended until the payment is settled.

5. Cancellation

The Client may cancel at any time from their dashboard (Account, then Payment and invoices). Cancellation takes effect at the end of the current month; the month already started is not refunded.

6. Data of the Client's customers

The Client is the controller of the personal data of their own customers. Fidelbee acts as a processor within the meaning of Article 28 of the GDPR: it processes this data only on the Client's instructions and in order to provide the service, protects it with appropriate technical measures, imposes the same confidentiality obligations on its technical sub-processors (Supabase, Vercel, Stripe, Apple, Google, OpenStreetMap), assists the Client in responding to requests from their customers, informs the Client without delay of any personal data breach, and deletes this data no later than 3 months after the end of the contract.

The Client is solely responsible for the content of the messages, coupons and offers they send to their customers. These messages are only sent to customers who have agreed to receive them.

7. Reviews of Fidelbee

The Client may leave a review of Fidelbee from their dashboard. With their consent, this review may be published on the website together with the name of their business. They may edit or withdraw it at any time.

8. Liability

Fidelbee endeavours to keep the service available at all times, but cannot guarantee it. Its liability is limited to the amount paid by the Client over the last three months.

9. Governing law and language

These terms are governed by Belgian law. Any dispute falls within the jurisdiction of the courts of the judicial district of [VILLE]. These terms exist in several languages; in the event of any discrepancy, the French version prevails.
